Sonova, headquartered in Stäfa, Switzerland, is a leading manufacturer of innovative hearing care solutions. The Sonova group operates mainly through its core business brands Phonak, Unitron, Advanced Bionics, Hansaton and Audionova.  

Within the context of marketing and providing educational information in the field of hearing devices and wireless communication solutions, you as a customer or expert in the hearing field have agreed to report about your experiences with hearing devices or respective accessories.  

By signing this document you declare that you have read, understood and voluntarily agree to the following:

• You agree that the statements reflect your personal experience, are genuine, true and accurate, and represent your honest opinion.

• Sonova AG, Laubisrütistrasse 28, 8712 Staefa, Switzerland, its affiliated and related companies and their respective successors and assigns (collectively “Sonova”) are allowed to use photos, images, videos, and sound recordings that feature you, your voice or your likeness, your name and bibliographical data, your testimonial statements and all other data (“Materials”) provided by you to Sonova.  

• You hereby irrevocable grant an unlimited, transferable, worldwide permission to Sonova, to use the Materials in any Media for any purpose (including, among others, advertising, promotion, marketing and education purposes for any product or service related to Sonova’s business). For the purpose of this release, “Media” means all media including online, including social media, digital, electronic, print, television, radio, film and other media currently known. You irrevocably waive all your rights, including moral rights, in and to the Materials. You agree that Sonova shall own all right, title and interest in and to the Materials (including all content and all rights embodied therein).  Any Materials collected shall not be returned to you.  

• You irrevocably waive any right to inspect or approve any finished product in any Media, including advertising, promotional and marketing materials, that may be or have been created in connection with the Materials.  

• You agree that the Materials, while respecting your personality rights, may be combined with other images, text and graphics, and or edited, cut, cropped, altered, rearranged, adapted, dubbed, or otherwise modified in Sonova’s sole and absolute discretion.  Any modification to your testimonial will accord substantially to the meaning of your statements.   

• You confirm that the provided Materials do not infringe or violate any third party’s rights, (including intellectual property rights), rights of publicity, defamations and false endorsement and you will defend, indemnify and hold harmless Sonova from and against any and all claims resulting from use of the Materials. 

• You further understand there will be no monetary compensation paid to you, in connection with the use of the Materials or in connection with your contribution.

• You agree to treat all information made available by or on behalf of or at the request of Sonova as strictly private and confidential until its first publication.
